Kathleen Maude Clark of Bovey Tracey in the County of Devon, Widow, hereby revoke all Wills Codicils and testamentary dipositions theretofore made by me and declare this to be my last Will and testament- 1. I appoint Henry James Noel Heath of Sunbeam Bovey Tracey aforesaid Esquire, Heathfield MacMahon Mahon of 33 Ely Place Holborn in the County of London Esquire and Richard Jocelyn Woollcombe of 33 Courtenay Street, Newton Abbot in the County of Devon Esquire (who and the survivors and survivor of whom and the executors or administrators of such survivors or other Trustees or Trustee for the time being of this my Will are hereinafter referred to as "my Trustees") to be the EXECUTORS AND TRUSTEES of this my Will And I bequeath to each of them the said Henry James Noel Heath, Heathfield MacMahon Mahon and Richard Jocelyn Woollcombe who shall prove this my Will and act in the trusts hereof a legacy of fifty pounds free of duty as an acknowledgement of his trouble in so doing - 2. I bequeath to Amy Elizabeth Langworthy now living at Ashlyn, Coronation Road, Worle, near Western Super Mare the sum of fifty pounds free of duty And to Herbert Wills now living at South View, Bovey Tracey aforesaid the sum of Ten pound free of duty And I direct that if the said Herbert Wills shall be an infant at the time of my death the reciept of his parents or guardian shall be a good discharge to my Trustees for the said legacy- 3. I declare that it was never my intention to accept repayment of the sum of ninety pounds which I advanced to my brother Henry Grant Beadel in February One thousand nine hundred and eleven on Mortgage of 58 Raglan Road, Plumstead or to accept any interest on such advance and I direct that if I shall not have given my said brother or his personal representatives a receipt in full discharge of such Mortgage debt in my lifetime my Trustees shall do so after my death and that my said brother shall not be charged with my legacy duty if such shall be claimed by the Estate Duty Office- 4. I bequeath (a) The pair of oil paintings of my Grandparents Mr and Mrs James Beadel and the oil painting of my Great Grandfather Mr Grant free of duty to the eldest male desendant of Mr and Mrs James Beadel (b) The enlarged photographs of my grandparents Mr and Mrs Henry Woods and the miniature of Henry Stanley (date 1725) free of duty to the eldest of my cousins children of my late Uncle William Henry Woods (c) To the Royal Naval College, Museum Grenwich free of duty my pencil drawing of Nelson's "Victory" drawn by Miss G Stanley, sister of Rear Admiral Stanley as the Victory was moored after her last voyage, also a piece of barnacle taken from the Victory- 5. I bequeath to my Trustees my very perfect French Louis the XIV Cabinet of Marquetrie work the companion table to which is in the Louvre. Upon trust to offer the same for not less than Eleven thousand pounds to the Authorities of the Louvre Paris. And should they not desire to purchase the same at sucll in their absolute descretion consider adequate. Upon trust to offer the same for sale to the authorities of the British Museum. And should they not desire to purchase the same at such price as my trustees shall in their absolute descretion consider adequate. Upon trust to sell the same either by public auction or private contract as they shall in their absolute and uncontrolled discretion think fit. And to stand possessed of the proceeds of sale thereof after deducting all costs charges and expenses of or in connection with the sale to whomsoever the sale may be made. In trust as to one half part thereof free of duty for the Royal Hospital for Incurables, Putney Heath and as to the other half part thereof free of duty Upon the trusts declared in clause 6 below concerning my residuary estate. And I direct my Trustees to ensure the said cabinet after my death against fire or other risks in such manner and for such sum as they may in their absolute discrestion think fit and any trustees shall insure no liability to reason of their failure to insure on the inadequacy of an insurance they may effect- I give devise appoint and bequeath all the real and personal property whatsoever and wheresoever of or to which I shall be seised possessed or entitled at my death or over which I shall then have any general power of appointment or disposition by Will (except any property otherwise disposed of by this my Will or any codicil hereto) unto my trustees Upon Trust that my Trustees sahll sell call in collect and convert into money according to the nature of the premises the same or such part or parts thereof as shall not consist of money at such time or times and in such manner as my trustees shall think fit (but as to any reversionary property not until it falls into possession unless it shall appear to my trustees that an earlier sale would be beneficial) And shall with and out of the moneys produced by such sale calling in and conversion and with and out of such partsof my estate as shall consist of money pay or provide for my funeral and testamentary expenses debts and liabilities and the legacies bequeathed by this my Will or any codicil hereto and all estate and other duties payable on my decease. And I declare that my Trustees shall stand possessed of the of the residue of the said moneys (hereinafter referred to as 'my residuary estate') Upon the trusts in favour of The Seale Hayne Agricultural College and others declared by a Trust Instrument' dated the fourth day of February One Thousand Nine and Thirty made between myself of the one part and the said Richard Jocelyn Woollcombe and Henry James Noel Heath of the other part concerning the trust fund therein referred to- I empower my Trustees in their uncontrolled discretion to postpone during such period as they shall think fit and exceeding one year from my death and without being responsible for any loss occasioned thereby the safe calling in and coversion of the whole or any part or parts of my estate real or personal. And I declare that all the net rents profits and income arising from my estate real or personal until the safe calling in and conversion there of in whatever condition or state of investment the same may be shall as well during the first year after my death as afterwards be applied as if the same were income arising from the proceeds of such safe calling in or conversion or the investments of such proceeds are part thereof being able to be reclaimed as capital but that no reversion or other property not actually producing income shall be treated as producing income for the purposes of this Will.- My Trustees may at any time or times at their discretion appropriate any part of my residuary estate in its then actual condition or state of investment in or towards satisfaction of any legacy or share in such residuary estate with powers for that purpose conclusively to determine the nature of my residuary estate or any part or parts thereof in such manner as they shall think fit.- I authorise my Trustees to determine what articles pass under any specific bequest contained in this my Will or any codicil hereto and whether any moneys are to be considered as capital or income and whether any expenses outgoings or other payments or gift to be paid out of capital or income and how valuations are to be made or value determined for the purpose of any case of allotment or appropriation or otherwise and to determine all questions and matters of doubt arising in the execution of the trusts of this my will or any codicil hereto. And I declare that every such determination whether made upon a question actually raised or implied in the acts or proceedings of my Trustees shall be conclusive and binding on all persons interested under this my Will or any Codicil hereto.- I hereby declare that my Executors or Trustees shall not be bound in any case to act personally but may employ a solicitor or any other agent to contract all or any business of whatsoever nature required to be done in the premises (including the receipt and payment of money) and shall be entitled to be allowed and be paid all charges and expenses so incurred and shall not be answerable for the default of such solicitor or agent or any loss occasioned by his employment. And I further declare that the said Heathfield MacMahon Mahon and Richard Jocelyn Woollcombe and any other Executor or Trustee for the time being hereinunder being a solicitor or other person engaged in any professional or other charges for any business done by him or his firm in the premises whether in the ordinary course of his profession or business or not and although not of nature requiring the employment of a solicitor or other professional person.- In Witness where I the said Kathleen Maude Clark have hereunto set my hand to this my Will contained in this and the hence proceeding sheets of paper this Twenty Fifth day of February One Thousand Nine Hundred and Thirty.
